Condo and Coop – DBPR Meeting Notice Requirements

Meeting notice requirements for condominiums and cooperatives in Florida are established in the Florida Statutes and further detailed in the Florida Administrative Code. The Department of Business and Professional Regulation (DBPR) oversees these requirements, ensuring associations provide proper notice to unit owners about meetings.

Here's a general breakdown based on my last update in January 2022:

Condominiums (Chapter 718, Florida Statutes):

  1. Board Meetings:

    • Regular board meetings: At least 48 hours posted notice (or as provided in the bylaws) unless bylaws mandate longer.

    • Meetings to discuss special assessments or rule changes affecting unit use: Written notice mailed, delivered, or electronically transmitted to the unit owners and posted conspicuously on the condominium property at least 14 days before the meeting.

  2. Annual and Members' Meetings:

    • Written notice must be mailed, delivered, or electronically transmitted to each unit owner at least 14 days prior to the annual meeting and must be posted in a conspicuous place on the condominium property at least 14 continuous days before the annual meeting.

Cooperatives (Chapter 719, Florida Statutes):

  1. Board Meetings:

    • Regular board meetings: At least 48 hours posted notice (or as provided in the bylaws) unless bylaws mandate longer.

  2. Members' Meetings:

    • Written notice for meetings and annual meetings must be mailed or delivered to each shareholder at least 10 days prior to the meeting (unless the bylaws require a longer period).

For both condos and co-ops, any meeting at which assessments against unit owners are to be considered for any reason requires that notice be mailed, delivered, or electronically transmitted to the unit owners and posted conspicuously on the property not less than 14 days before the meeting.

Additionally, if any non-emergency meeting cannot be noticed as required due to hurricane conditions, the notice requirement can be waived upon advice of emergency management officials or upon the advice of licensed professionals.
